Temporary Graduate visa (subclass 485) Replacement stream

Temporary Graduate visa (subclass 485) Replacement stream

  

This visa is for current and former Temporary Graduate visa holders who lost time on their original visa due to COVID-19 travel restrictions. It lets you live, work and study in Australia temporarily.

To apply for this visa

You must be under 50 years of age.

you must either:

  • hold a Temporary Graduate visa as the main holder; or
  • have held a Temporary Graduate visa as the main holder and currently hold another substantive visa, or a Bridging visa A or Bridging visa B.

You will be eligible to apply if, as the main holder:

  • you have held a Graduate Work stream or first Post Study Work Stream Temporary Graduate visa that was:
    • granted before 15 December 2021 and
    • in effect on or after 1 February 2020
  • have lost time on your visa because of Australia’s COVID-19 travel restrictions. This means:
    • if you were in Australia when your original Temporary Graduate visa was granted, you have been outside of Australia while holding this visa between 1 February 2020 and 14 December 2021
    • if you were outside Australia when your original Temporary Graduate visa was granted, you entered Australia on that visa, and the departed Australia on that visa before 15 December 2021
  • have not had your Temporary Graduate visa, or any visa granted after you held your Temporary Graduate visa, cancelled, unless it was cancelled because you asked for it to be, or the decision to cancel the visa was set aside by the Tribunal.

VICTORIA 190 AND 491 UPDATES (21 DECEMBER 2020)

Subclass 190 and  Subclass 491 Updates

Victoria’s skilled visa nomination program (subclass 190 and 491) reopens on 5 January 2021


Victoria’s full 2020-21 skilled visa nomination program (subclasses 190 and 491) will re-open at 10am AEDT on Tuesday, 5 January 2021.


Like the interim program, the full program responds to challenges posed by the coronavirus pandemic, with a focus on Victoria’s health response and economic recovery.


The Commonwealth Department of Home Affairs has allocated the Victorian Government further visa nomination places, in addition to the places provided as part of the interim program.


To be eligible to be considered for selection to apply for Victorian skilled visa nomination, you must meet the criteria outlined below:


Subclass 491

  1. Already be living in regional Victoria
  2. Already be working in regional Victoria (minimum 3 months employment)
  3. Work in a highly skilled occupation in health, medical research, life sciences, agri-food or digital sectors which supports Victoria's economic recovery and/or health response.

Second Temporary Graduate Visa (18 December 2020)

Applications for the Second Temporary Graduate Visa(TGV ) in the Post-Study Work stream can be made from 20 January 2021, when the Amendment Regulations commence.

A first Temporary Graduate Visa holder in the Post-Study Work stream can apply for, and be granted, a second visa if they meet the eligibility requirements. Eligibility can arise on the basis of where the applicant lived, studied and worked before and/or after the commencement of the Amendment Regulations.


The period of grant for a second TGV will be determined based on where the student studied and where they lived (and worked or studied, if relevant) on their first TGV.


The second Subclass 485 Graduate visa in the Post-Study Work stream will be granted with a visa validity of one or two years from the date of visa grant and will require visa holders to remain in a regional area for the duration of their new visa.

NSW 491 Updates (15 December 2020)

News and Updates

Regional Development Australia (RDA) offices will begin assisting NSW Treasury manage the subclass 491 visa in early February 2021.


Each RDA office will accept and assess applications, and determine eligible occupations for their respective regions; however, nomination criteria is consistent across all regions.


RDA offices will focus on nominating applicants who are undertaking skilled work in critical sectors. These applicants are a priority for Government in supporting economic recovery following the impacts of COVID-19.

NSW 491 Requirements Updates (17 November 2020)

Nomination Criteria


You must meet the all criteria in one of the three following three streams to be eligible for NSW nomination:


  • Living and working in regional NSW;
  • recently completed study in regional NSW; or
  • living and working outside of NSW.

 

Applicants who do not meet the criteria in one of these three streams may be refused unless otherwise agreed with NSW Treasury.


'Closely related occupations' are defined as those having the same ANZSCO unit group, i.e. sharing the same first four digits.


'Designated regional areas' are determined by Home Affairs. Please see their website for a list of regional NSW postcodes.


1. Living and working in regional NSW

To be eligible for NSW nomination under this stream you must:


  • hold a valid skills assessment for an occupation that appears on your nominated region's occupation list;
  • have been living in a designated regional area in NSW for at least the previous 12 months; and
  • have been working in your nominated occupation, or a closely related occupation, in a designated regional area of NSW, for at least the previous 12 months.

 

2. Recently completed study in regional NSW

To be eligible for NSW nomination under this stream you must:

 

  • hold a valid skills assessment for an occupation that appears on your nominated region's occupation list;
  • have completed study or education with an education provider, where:
  • the study was completed within the previous 24 months;
  • the education provider is located in a designated regional area in NSW;
  • the study meets the Australian study requirement (as determined by Home Affairs from time to time); and
  • the qualification obtained from this study has been assessed as closely related to your nominated occupation by the relevant assessing authority; and
  • have lived in a designated regional area of NSW while completing your study.


3. Living and working outside of NSW

To be eligible for NSW nomination under this stream you must meet all the criteria for at least one of the following categories:


A. Job offer in regional NSW

To be eligible for NSW nomination under this category you must:

 

  • hold a valid skills assessment for an occupation that appears on your nominated region's occupation list;
  • have an offer for ongoing employment that is:
  • in the Applicant's nominated occupation, or a closely related occupation; and
  • for a minimum term of 12 months and 35 hours of work per week;
  • have an offer for ongoing employment from an employer that is:
  • located in a designated regional area in NSW; and
  • registered in Australia.

 

B. At least five years skilled employment experience (offshore Applicants)

If you reside outside of Australia, you must:

 

  • hold a valid skills assessment for an occupation that appears on your nominated region's occupation list; and
  • have at least five years of skilled employment in such nominated occupation, or a closely related occupation.

 

C. Family ties in regional NSW

To be eligible for NSW nomination under this category you must:


  • hold a valid skills assessment for an occupation that appears on your nominated region's occupation list; and
  • have an immediate family member in a designated regional area in NSW who satisfies all of the criteria below:
  • a grandfather, grandmother, father, mother, brother or sister of the Applicant (including by virtue of a step or adoptive relationship);
  • at least 18 years of age;
  • either an Australian Permanent Resident, an Australian Citizen or a NSW nominated provisional visa holder (489);
  • currently residing in a designated regional area in NSW; and
  • has been residing in a designated regional area in NSW for at least the previous 24 months,
  • and you must ensure that your family member has completed a statutory declaration to confirm that they satisfy each of the above chain migration requirements.
